Service Agreement

AMITY BREEZE COW FLOATING SERVICES AGREEMENT

This agreement is between Amity Breeze Ag and Cattle Co LLC (referred to as the “Business”) and you, the owner or authorized representative of the cow receiving Services (referred to as the “Client”). By signing below, you are entering into this legally binding agreement.

1. SERVICES.  Upon the Client’s request, the Business will deliver and place a floating tank on the Client’s property. The Business will assist the Client in placing their cow in the tank for floating therapy treatment in an attempt to rehabilitate the cow. Collectively, this is referred to as the Services.

2. ASSUMPTION OF RISK. The Client acknowledges and accepts that the Services carry inherent risks, including but not limited to the injury, illness, or death of the animal. The business makes no warranties, guarantees, or promises regarding the safety or effectiveness of the Services. The Business cannot predict or control the outcome of the treatment. The Client agrees to assume all risks associated with the Services and is proceeding entirely at their own discretion. 

3. RESPONSIBILITY FOR THE ANIMAL.  The Client assumes full responsibility for the health and welfare of their cow during and after the Services. The Business shall not be liable for any injury, illness, death, or any other condition affecting the animal, whether occurring during the Services or anytime thereafter. The Client agrees not to hold the Business responsible, make claims against the Business or its owners or employees, or pursue legal action against the Business for any reason related to the animal’s condition or outcome. 

4. THE TANK STAYS ON YOUR PROPERTY.  The floating tank will sit on the Client’s property (or at a location requested by the Client) and the Client agrees to take full responsibility for the care, security, and protection for the floating tank at all times while in the Client’s possession. The Client shall maintain the tank, prevent unauthorized access, protect it from weather damage, and ensure it is not stolen or damaged. The Business is not liable for any damage while in the Client’s possession.  The Client shall notify the Business immediately of any damage or incidents involving the tank.

5. CLEANING THE TANK.  After the animal is removed from the tank, the Client agrees to wash the interior and exterior of the tank with soap and water. All debris (mud, straw, etc) and fluids (including but not limited to blood, placenta, feces, etc.) must be removed from the tank before the Business removes the tank from the Client’s property. Failure to clean the tank will result in a $100 cleaning fee added to the floating bill.

6. INDEMNIFICATION AND HOLD HARMLESS.  The Client agrees to indemnify and hold harmless the Business from and against any and all claims, damages, injuries, losses, and liabilities arising from or related to the Services or the floating tank while in the Client’s possession. This includes, but is not limited to (a) bodily injury or death of any person; (b) physical damage to or destruction of the float tank; (c) loss, theft, or disappearance of the float tank or its components; (d) property damage or environmental damage; or (e) any medical expenses, legal fees, or other costs from incidents related to the Services. The Client shall pay all associated costs, including medical bills, property repairs, insurance claims, and legal expenses resulting from any incident covered by this clause.

7. SIGNATURES & COPIES.  The Client may execute this agreement using an electronic signature, which shall have the same legal effect as handwritten signatures and are fully binding. A copy of this agreement is available on the Business’ website (www.amitybreeze.com). The Client may request a printed copy at any time.

8. CLIENT ACKNOWLEDGMENT.  By signing this agreement, the Client acknowledges that they have read and fully understand all terms and conditions. The Client represents that he/she is the lawful owner of the cow receiving the Services or is an authorized representative and allowed to enter into this agreement on behalf of the owner. The Client voluntarily assumes all risks and agrees to all the terms. The Client is not relying on any representations or guarantees other than those stated in this document.
